This Acceptable Use Policy forms a part of the livingmemoryTM Terms & Conditions of Use.
Unless the context requires otherwise, words used in this Acceptable Use Policy have the meaning given in the livingmemoryTM Terms & Conditions.

By accessing or otherwise using livingmemoryTM you agree:
  1. To comply with and be bound by the livingmemory Terms & Conditions of Use, this Acceptable Use Policy and any other applicable policies and procedures relating to livingmemory, us or goods or services promoted in connection with livingmemory, as amended from time to time;

  2. To use the information and services provided through livingmemory only for their intended purpose;

  3. That any material provided to us or uploaded or sent to or through livingmemory by you must be accurate and not misleading;

  4. To promptly update any information you are required to provide to us to use livingmemory or any related goods or services so as to keep it accurate, complete, current and not misleading. We may use any such information for any purpose subject to our Privacy Policy;

  5. That any distribution or use of material provided to us or posted or sent to or through livingmemory by you will not infringe or cause the infringement of the intellectual property or any other rights of any person;

  6. Not to engage in any conduct related to us or livingmemory that is unlawful, obscene, defamatory, vilifying, racist, harassing, abusive, tortious, unlawfully discriminatory, offensive, objectionable or inappropriate, or might cause harm of any kind to any person or property or which might encourage illegal activities (including by sending, uploading, providing links to or otherwise making material available through livingmemory);

  7. Not to breach any applicable laws or send, upload or link to any information or material that you are not legally entitled to (including confidential information of any person or information about minors that it is unlawful to disclose);

  8. Not to fraudulently or otherwise misrepresent yourself to be another person, a representative of another person or us, or to have an affiliation with a person, entity or group;

  9. Not to send, upload or make available any material containing or associated with spam, junk mail, virus warnings (without first confirming the authenticity of the warning), or any other form of unauthorised advertising or promotional material;

  10. Not to stalk or harass other Users and to cease communicating with any User through livingmemory upon that User’s request, unless such communication is lawful and necessary to enforce your legal rights or comply with your legal obligations;

  11. Not to seek or obtain unauthorised access to or interfere with the performance of the computer systems or telecommunications links that support livingmemory or third parties, nor to send, upload, link to or make available any information or material that contains viruses or code designed or intended to gain unauthorised access to, disrupt, impair, harm or destroy the performance of any hardware or software;

  12. Not to disguise the origin of any material transmitted to or through us or livingmemory (including by forging message or packet headers);

  13. Not to use automated means to enter or download material from livingmemory (whether using computer software or otherwise);

  14. Not to resupply livingmemory or any related material or services to third parties;

  15. Not to, without the express consent of us or the relevant Users, collect or use information, material or data about any Users (whether aggregated or otherwise) unless such collection or use is lawful, in accordance with the Terms and for a purpose related to the purpose for which the information was provided or made available and, in any event, not for a commercial purpose;

  16. To complete any transaction entered into with us or in connection with livingmemory;

  17. To report any User’s breach of this Acceptable Use Policy to us; and

  18. To indemnify us against all claims, loss or damage we suffer (including indirect and consequential loss or damage) as a result of your breach of this Acceptable Use Policy.

    We may amend this Acceptable Use Policy at any time without notice by posting the updated Policy in the “Terms and Conditions” (or equivalent) section of livingmemory. We recommend that you regularly check livingmemory for any changes.
