- About livingmemoryTM
We own and operate livingmemory,
which is an online service that allows registered members of the site to set up
unique personal profiles that can be linked together through networks of friends,
personal contacts and other common information. LivingMemory members can view select
parts of each others' profiles, communicate with old friends, meet new friends,
share photos, post journals and comments, and describe their interests. To enrich
our members' and guests’ experiences, we request and display some personal information
to other members and guests that allows our members to identify each other and expand
their network of friends. What personal information will be disclosed in this way
will be apparent at the time of collection. (When we talk about personal information,
we mean information or an opinion from which a person’s identity is apparent or
can reasonably be ascertained.)

members can change their profile information at any time and can control how other
members and the service communicates with them. Refer to the section below on “Correcting/Updating
or Removing Information”.

- Collection and Use of Information by
livingmemoryTM
What we collect
We collect member-submitted information such as name, email address, gender and
age to authenticate members and to send notifications to those members relating
to the LivingMemory service. If you do not provide the information we may not be
able to provide our services to you.
We also collect other member-submitted data including (but not limited to) members’
stories, family tree, photos, blogs, personal interests, education and occupation
as well as your final wishes and messages in order to assist members in sharing
information about themselves with other members like friends and family and to assist
members to find and communicate with each other.
Where reasonable or practicable we will collect your personal information only directly
from you. Our purpose for collecting personal information should be clear
at the time of collection.
We may also supplement the personal information we collect from a member with information
provided by other members and guests (such as where members’ invite people to add
comments to their stories or where other members include personal information about
other people in their own life stories).

also log non-personally identifiable information, such as IP address and browser
type, from all members and guests of the site. This data is used to manage the website,
track usage and improve the website services. Members’ IP addresses are recorded
for security and monitoring purposes.
How personal information is used
and disclosed
We do not use members’ personal information for purposes other than as disclosed
at the time of collection or as stated in this privacy policy.
Except as stated in this privacy policy, we will not disclose personal information
to any third party without a member's explicit permission. We reserve the right
to disclose your personally identifiable information as required by law and when
we believe that disclosure is necessary to protect our rights and/or comply with
a judicial proceeding, court order, or legal process served on our website. We will
co-operate with law enforcement agencies to the extent and in the manner we are
entitled to do so.
We will only use or disclose your personal information to:
- other guests and/or members of
livingmemory as outlined in the "How livingmemory shares
information within the livingmemory
network";
- supply you or another person with goods, services or information
at your request;
- help us improve our website, marketing, goods and services
and includes third party service providers to our business such as mailing houses,
courier companies, contract auctioneers, event organizers, IT contractors such as
website developers and hosts, lawyers, accountants, financiers, marketing consultants
and promotions companies. Third party service providers are prohibited from using
your personal information in any way other than in the performance of their services
to our business;
- tell you about our range of products and services and any
new developments, offers or events we think may interest you and to help us develop
and promote our other products and services and to provide improved customer service;
- credit reference and reporting agencies and other credit providers
where you apply for or obtain credit from us; and
- any other organization that may have or is considering taking
an interest in any part of our business or assets. If an ownership change occurs
to more than 50% of our business or assets, members will be notified shortly after
the change.
How livingmemory shares information
within the livingmemory network
Information specified in a member’s profile is displayed to other LivingMemory guests
and members in order to facilitate interaction in the LivingMemory social networking
community. The information that is mandatory for members to share is clear at the
time of collection and includes name, date of birth, city/town/suburb, zip/post
code and country of residence. Other member information is displayed to other guests
and/or members only when the member has explicitly authorized such information to
be displayed.
To facilitate searching and finding friends and acquaintances on the service, LivingMemory
allows guests and members to search for members using “Profile” information like
first and last name and information detailed in the “My Life” section of the site
like schools or companies where members may have attended or worked.
livingmemory
does not disclose to guests and other members the member's personal email address
recorded in the member’s profile. Members within a LivingMemory personal network
communicate with each other through livingmemory using a LivingMemory online member facility.
Members may, however, choose to include their personal e-mail address in material
sent through livingmemory
if they wish guests and/or other members to have access to that address.
Email addresses may be used by members for the purposes of inviting new friends
to join livingmemory.
We may also use a member’s email address to send updates, newsletters or announcements
regarding the service. Members may choose not to receive email of this type by changing
their "Notification" setting in the member "Preferences". Refer to the “Email Choice/Opt-out”
section below.
From time to time, we or a third party may sponsor a promotion, sweepstake or contest
on livingmemory.
Members may be asked to provide personal information including name, email address
or home address or to answer questions in order to participate. Participation is
voluntary and you therefore have a choice as to whether or not to disclose this
information. We may transfer personal information to third parties who sponsor activities
you agree to participate in or that you have explicitly requested to receive information
from. The information that will be transferred will be notified to you when you
are invited to participate or request additional information. It will be clear at
the point of collection who is collecting the personal information and whose privacy
statement will apply.
- Correcting/Updating or Removing Information
livingmemory
members may modify or remove any of their member-submitted personal information
at any time by logging into their account and accessing features such as “Profile”
and “Preferences” or by contacting us at our postal address (see below). We may
retain a copy of your personal information in backups of the site and to protect
our legal interests.

may ask you to pay our reasonable costs of providing access.
If you believe personal information we hold about you is inaccurate or incomplete,

We will generally take reasonable steps to correct your personal information where
inaccuracies are identified.
In certain circumstances, we may refuse to give access to your personal information
or amend it (such as where that information was provided by another member and we
have a confidentiality obligation not to disclose it or where we are allowed or
required by law to refuse access). Usually we will explain why and, in the case
of amendment, make a note that you have disputed the accuracy or completeness of
particular information.
- Invitations and Other Communications to Non-members
livingmemory
members can invite friends to join the service by sending invitation emails via
our automated invitation system. We store the email addresses that members provide
so that the recipients may be added to the “friend's list” of the member sending
the invitations, and also to send reminders of the invitations. We do not sell these
email addresses or use them to send any other communication besides invitations
and an invitation reminder. Recipients of invitations from
livingmemory may contact us to request the removal
of their information from our database by clicking on the Unsubscribe button at
the bottom of the invitation.
Our members may also store email addresses of people they know in their internal
livingmemory
address book and may also choose to send invitations and other communications to
those addresses.
You may prevent livingmemory
email invitations and other messages from being sent to any email address you control
by sending a single email with the subject "BLOCK" to
privacy@livingmemory.com. Please note that the email must come from the
account you wish to block.
- Use of Cookies
livingmemory
uses cookies to store members’ preferences and to record session information for
purposes including ensuring that members are not repeatedly offered the same advertisements
and to customize newsletter, advertising, and web page content based on browser
type and member profile information. You may be able to configure your browser to
accept or reject all or some cookies, or notify you when a cookie is set.
Each browser is different so check the "Help" menu of your browser to learn how
to change your cookie preferences. However, you must allow cookies from LivingMemory
in order to use most functions on the site. We link the information we store in
cookies to personally identifiable information you submit whilst on our site

contains links to other sites. We are not responsible for the privacy policies or
practices on those sites. When following a link to another site a member should
read the privacy policy stated on that site. This privacy policy only governs information
collected on livingmemory.
- Chat Rooms, Journals and WebLogs, Message Boards, Classifieds, Public Forums
and other areas containing Public Information
Please be aware that whenever you voluntarily post personal information that can
identify you or be used to locate you to Life Stories, Journals, WebLogs (Blogs),
Message Boards, Classifieds or any other Public Forums, then that information can
be accessed by the public and can in turn be used by those people to send you unsolicited
communications. Examples of personal information that may allow unauthorized use
by the public includes the poster’s name and information contained in the body of
a message, a profile or thread.
- Email Choice/Opt-out
Members who no longer wish to receive updates or notifications may choose not to
by selecting “Switch off updates and offers” in the “Preferences” section. All notification
emails and livingmemory
newsletters also include the above instructions for opting-out of those communications
in the future. Alternatively, you may contact us by email at
support@livingmemory.com. All opt-out requests will be honored as soon as
possible (generally immediately).
- Security
livingmemory
member accounts are secured by member-created passwords. Certain areas within the
site provide you with an option to submit information to the site using encryption
to reduce the risk of that information being intercepted while it travels across
the Internet. We use reasonable measures to protect member information that
is stored within our database, and we restrict access to member information to those
employees and third party contractors who need access to perform their job functions,
such as customer service personnel and technical staff.
Members are responsible for maintaining the security and privacy of their member
account information to prevent unauthorized access to their accounts.

- Changes in Our Privacy Policy
From time to time we may make changes to our privacy policy. If we make changes,
we will post them on our site to make members aware of what the changes are. A member
is bound by any minor changes to the policy when she or he uses the site after those
changes have been posted. If, however, we are going to use members' personally identifiable
information in a manner materially different from that stated at the time of collection,
we will notify members by posting a notice on our site for 30 days prior to the
introduction of the change. If a member is not comfortable with the change, a member
may cancel his or her membership by selecting the Cancel Membership button at the
bottom of the Profile page.
